List Pro 1.0 Real Estate Software License Agreement

This is a legal agreement between you and List Pro 1.0 Real Estate, covering your use of (the "Software"). Be sure to read the following agreement before purchasing or using the Software.

All List Pro 1.0 Real Estate's software is provided subject to the terms of the license agreement. By purchasing and downloading the software you are agreeing to the terms of this license so please read it carefully before continuing. Please make sure that your server meets the requirements before purchasing! Because the software is being provided as source code, we regret that we can't offer refunds unless the purchase was made within 14 days of the refund request.

Outline of the license terms: You may install each license of the software on a single website domain. You may not lease, sell or re-distribute any List Pro 1.0 Real Estate software. All List Pro 1.0 Real Estate software is provided as is. Changes to the source code will void your package support for any areas of the script that have been changed. List Pro 1.0 Real Estate and/or it's software copyrights and branding cannot be removed unless the "unbranded" version of the software is purchased at extra cost of $600. List Pro 1.0 Real Estate reserves the rights to change this license agreement at anytime with out any notice. It is the purchasers’ responsibility to check this license agreement for changes regularly.

Refunds are not issued for server failure/issues, lack of features or if your server does not meet the Software Requirements. Please be sure to check your server requirements before purchasing or contact us at support@techandmedia.com.

BY USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE AND DESTROY ALL COPIES IN YOUR POSSESSION

The Software is owned by List Pro 1.0 Real Estate- by NOK DESIGNS and is protected by United States copyright laws and international treaty provisions. Therefore, you must treat the Software like any other copyrighted material.

The Software is provided as is and must be purchased on the assumption that it will not be supported. List Pro 1.0 Real Estate makes no guarantee of any offer of support for problems arising through use of the Software.

Purchasing this software allows you the right to use it on a single personal computer operating on a private network and/or a single public website. A website shall be defined as any text, image and binary data retrieval service operating on a computer, accessible at a single internet domain name, by means of a remote computer, over a public network, using the hypertext transport protocol over TCP/IP.

You may install the Software on behalf of a third party subject to their agreeing to be bound by the terms of this license but you may not re-distribute, sell, rent or lease the Software to others. You may make modifications to the software but the original license agreement will remain in force for the modified version. If you violate any part of this agreement, your right to use this Software terminates automatically with no email or phone support and you must then destroy all copies of the Software in your possession.

The Software and its related documentation are provided "AS IS" and without warranty of any kind and List Pro 1.0 Real Estate expressly disclaims all other warranties, expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Under no circumstances shall List Pro 1.0 Real Estate be liable for any incidental, special, or consequential damages that result from the use or inability to use the Software or related documentation, even if List Pro 1.0 Real Estate has been advised of the possibility of such damages. Examples of such damages may include but are not limited to hackers, spam, viruses, phishing, hardware failure, or software incompatibility. In no event shall List Pro 1.0 Real Estate liability exceed the license fee paid, if any.

The Software is to be solely owned by the purchaser. If NOK DESIGNS find that the Software owned by the purchaser is on the net being shared with others the purchaser will agree to lose all privileges of List Pro 1.0 Real Estate -NOK DESIGNS services. Being shared includes but is not limited to pirated copies, parts and/or the whole Software. The only files from the Software which are allowed to be shared are the language files and they are to only be shared on the List Pro 1.0 Real Estate forum with other license owners (purchasers). If the purchaser wishes to share other files the purchaser will need to contact List Pro 1.0 Real Estate before doing so or the purchaser will risk losing all List Pro 1.0 Real Estate services. These services include but are not limited to support, upgrades, forum, and future products.

This Agreement shall be governed by the laws of the United States. If for any reason a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision of the Agreement shall be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement shall continue in full force and effect.

The Software and documentation is provided with RESTRICTED RIGHTS as described in the License Agreement.
